摘要：O artigo aborda os debates que se desenvolvem no Brasil acerca das normas relativas ao imigrante em face da inadequação do Estatuto do Estrangeiro vigente e sua incompatibilidade com os novos paradigmas internacionais e regionais acerca dos direitos migratórios. Demonstra as dificuldades que se apresentam à regularização dos migrantes originários dos Estados-Membros e Associados do Mercosul, beneficiários dos acordos de residência, e seus efeitos restritivos ao acesso a direitos fundamentais. A análise foi possível devido à participação direta do imigrante nas plenárias livres realizadas no âmbito da Comigrar, promovida pelo Ministério da Justiça entre novembro de 2013 e maio de 2014.
其他摘要：The article discusses the debates that are developing in Brazil about the rules on immigration, and its inadequacy of the current Foreigner Statute in relation of the new international and regional paradigms about migration rights. It demonstrates the difficul- ties to the regularization of the original migrants from Mercosur Members and Associates States in receipt of housing agreements, and the restrictive effects on access to fundamen- tal rights. The analysis was possible due to the immigrantsdirect participation in the free public hearing held under the Comigrar, the First National Conference about Migration and Refugeethat had promoted by the Ministry of Justice from November 2013 to May 2014.
