摘要：Este artigo trata da Agência Estadual de Regulação de Serviços Públicos de Energia, Transportes e Comunicações da Bahia (AGERBA) e da Agência Reguladora de Saneamento Básico do Estado da Bahia (AGERSA), únicas agências reguladoras do Estado da Bahia. O objetivo proposto foi analisar a participação popular nessas agências mediante a adoção do modelo deliberativo como instrumento de legitimação dos atos regulatórios. A pesquisa foi realizada sob a vertente metodológica jurídico-dogmática, analisando-se a legislação vigente, assim como os conceitos jurídicos atinentes à temática. Conclui-se que o modelo deliberativo foi adotado pelas agências, mas, em diferentes níveis, fazendo-se necessária a revisão legislativa para aprimorar a participação popular.
其他摘要：This article deals with the State Agency for the Regulation of Public Services for Energy, Transport and Communications of Bahia (AGERBA) and the Basic Sanitation Regulatory Agency of the State of Bahia (AGERSA), the only regulatory agencies of the State of Bahia. The proposed objective was to analyze popular participation in these agencies and propose the adoption of the deliberative model as an instrument to legitimize regulatory acts. The research was carried out under the legal-dogmatic methodological aspect, analyzing the current legislation, as well as the legal concepts related to the theme. It is concluded that the deliberative model was adopted by the agencies, but at different levels, making a legislative review necessary to improve popular participation.
