摘要：En este estudio se aborda el supuesto del empresario plural, como particular zona gris del Derecho del Trabajo. Para ello, previamente, se lleva a cabo una contextualización de las zonas grises. Precisamente, dentro de dicho contexto, la figura del empresario plural llama la atención como relación triangular compuesta por dos empresarios y un trabajador. Al contrario de lo que ocurre con el resto de figuras ubicadas en las zonas grises, en su caso deben analizarse las características del Derecho del Trabajo y, en especial, la ajenidad y la dependencia desde el punto de vista de un concepto de empresario laboral distorsionado. Posteriormente, tomando como ejemplo el sector de la Marina mercante, y más concretamente, el ámbito de los pabellones de conveniencia, en el que se relacionan los navieros, los administradores de buques y los marinos, se describe la figura del empresario plural, y se indican los problemas que suscita y se proponen su correcta interpretación y sus posibles soluciones.
其他摘要：This study addresses the figure of the plural employer, since it is a particularly grey area to Employment Law. In order to achieve this, the grey areas are set in context, and it is within this context, that the figure of the plural employer draws one’s attention as a triangular relationship between two employers and a worker. Notwithstanding the aforegoing to the contrary, as regards other figures that may be found within these grey areas, the characteristics of Employment Law, and in particular, dependency and the provision to work under a contract of service, must be contemplated, taking into account a distorted employer perspective. Having done this, the figure of the plural employer is described pointing out its problems and offering possible solutions and its correct interpretation, following the guidelines found in the Merchant Shipping sector, and in particular, that of the flags of convenience, where the figure of the ship owner, ship administrator and sailor can all be closely interlinked.
