摘要：En la STC 27/2020 el Tribunal Constitucional se pronuncia acerca de la ilicitud de ilustrar una crónica periodística sobre un acontecimiento violento con una imagen de la víctima que había sido tomada de Facebook sin recabar consentimiento de su titular. El fallo estima que la publicación de una fotografía en una red social no equivale a una autorización para que terceros puedan hacer uso de la misma libremente y que la divulgación de la imagen de la víctima ni reviste interés informativo por sí, ni guarda relación de accesoriedad con la información contenida en el reportaje, por lo que aprecia la vulneración del derecho fundamental a la propia imagen.
