摘要：Zgodnie z art. 86c ust. 1 pkt 1 ustawy z dnia 27 lipca 2005 r. – Prawo o szkolnictwie wyższym senat uczelni wyższej uchwala regulamin zarządzania prawami autorskimi i prawami pokrewnymi oraz prawami własności przemysłowej oraz zasad komercjalizacji. W artykule została dokonana analiza definicji utworu naukowego zawartych w 25 regulaminach szkół wyższych, pomimo że przepisy prawa nie wymagajądefiniowania utworu naukowego w tych regulaminach. Analiza przeprowadzona przy uwzględnieniu przepisów ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych doprowadziła do wniosku, że zawarte w regulaminach szkół wyższych definicje utworu naukowego nie w pełni odpowiadają przepisom tej ustawy. Z tego względu rekomendowane jest traktowanie tych definicji jako autonomicznych i uwzględniających aspekty specyficzne dla profilu danej uczelni.
其他摘要：According to the Art. 86c para. 1 point 1 of the Act of Higher Education Law of 27 July, 2005 a senate of the higher education institution passes the Rules on management of copyright, related rights and industrial rights and Principles of their commercialization. Although that the Act does not impose an obligation on higher education institutions to define the notion of “scientific work”, all of them decided to define it. Thus an author analyses 25 definitions of “a scientific work” which are included in the Rule of the 25 different higher education institution. The author comes to conclusion that the definitions included in 25 different Rules are not fully compatible with an Act of 4 February, 1994 on Copyright and Related Rights. Thus it is recommended to consider the analyzed definitions independently from the Act on Copyright and Related Rights and to take into consideration some specific aspects of the profile of a higher education institution.
