摘要:Tujuan studi ini untuk mengkaji kepastian hukum bagi pencipta film drama korea terkait perlindungan hukum karya cipta sinematografi. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan komparatif. Hasil dari penelitian menunjukan bahwa pada karya film drama korea ini telah dilindungi sebagaimana diatur pada peraturan mengenai karya sinematografi terdapat dalam Undang-undang No. 28 tahun 2014 tentang Hak Cipta Pasal 9 mengenai hak ekslusif yang menyangkut hak ekonomi dan hak moral pencipta, serta fandom dapat kenakan Pasal 113 ayat (2), ayat (3), dan ayat (4) mengenai sanksi pembajakan. selain dari UUHC, diatur pula dalam UU No. 11 tahun 2008 tentang Informasi dan Transaksi Elektronik pada Pasal 32 mengenai sanksi yang dikenakan. Faktor ekonomi, kemudahan teknologi, kurangnya kesadaran KI dan fasilitas legal pada masyarakat indonesia mendorong fandom untuk melakukan pelanggaran. This study uses a normative legal research method with a statutory and comparative approach. The results of the study indicate that the Korean drama film works have been protected as stipulated in the regulations regarding cinematographic works contained in Law No. 28 of 2014 concerning Copyright Article 9 concerning exclusive rights concerning economic rights and moral rights of the creator, as well as fandom can wear Article 113 paragraph (2), paragraph (3), and paragraph (4) concerning piracy sanctions. apart from the UUHC, it is also regulated in Law No. 11 of 2008 concerning Information and Electronic Transactions in Article 32 concerning sanctions imposed. Economic factors, ease of technology, lack of awareness of IP and legal facilities in Indonesian society encourage fandom to commit violations.
