摘要：contrato en el que están expresadas las garantías del ciudadano, pues éste hace parte de él. De allí que el contractualismo sea la mejor forma de resolver los problemas de legitimación social y política en un Estado, garantizando los derechos fundamentales de sus participantes, partiendo de su realidad social, la cual es razón de ser de la justicia material velada por el juez constitucional como protector de los derechos. Todos estos elementos caracterizan al Estado Social de Derecho colombiano quien procura un Estado bienestar y un Estado Constitucional democrático, cuyo fin principal es limitar la arbitrariedad, para constituirse en un país garantista de los derechos del individuo.
其他摘要：The justification for the Social State Based on the Rule of Law is found in the nature of the agreement or contract in which the warranties of the citizens is expressed because they are part of the contract. That is why contractualism has been presented as the best way to solve all issues related to the social and political legitimation of a State. Based on the social reality of each individual, which is why material justice exists, the Social State based on the Rule of Law aims to protect the fundamental rights of the participants. Those elements are characteristics of the Colombian Social State based on the Rule of Law, which stands as a Welfare State and a Constitutional Democratic State. Its final purpose is to limit arbitrary actions in order to become a country that guarantees the fundamental rights of the individual.
