摘要：Genel kabule göre Ḥanef ī ler dışında kalan fukahanın çoğunluğu Hz. Peygamber’den nakledilen haberleri rivayet yoğunluğu açısından mutevātir ve āḥād olmak üzere iki kısma ayırmaktadır. Ḥanefīler ise mutevātir ve āḥād dışında meşhūr ḫaber in varlığını kabul etmektedir. Ancak Şāfiʿī fıkıh usûlünde mutevāti r ve āḥād dışında mustefīḍ ḫaber ile ilgili tartışmalar yer almaktadır. İşte bu çalışma Şāfiʿī fıkıh usûlünde mustefīḍ ḫaber in varlığına, kabulüne, bilgi değerine, Ḥanefī usûlündeki meşhūr ḫaber le benzerliğine-farklılığına ve mutevātir-āḥād ḫaber le kategorik ilişkisine dair tartışmalara değinmektedir. Netice olarak Şāfiʿīlerin mustefīḍ ḫaber ile ilgili tartışmalarının onları, Ḥanefīlerin üçlü haber taksimine yaklaştırdığını ve aradaki farklılıkları minimize ettiğini söylemek gerekir.
其他摘要：It is generally accepted that the majority of the fuqahāʾ (legal experts), except for the Ḥanafī school, divide the reports from the Prophet, with regard to the number of transmitters, into two parts: al-mutawātir and al-āḥād. Ḥanafīs, on the other hand, accept, beside these two, a third category in between: al-mashhūr. However, contrary to this widely accepted view, we see that Shāfiʿī uṣūl al-fiqh (legal theory) tradition contains discussions about mustafīḍ reports along with al-mutawātir and al-āḥād. This study deals with discussions about the presence, acceptance and epistemological value of mustafīḍ reports in the Shāfiʿī legal theory. Furthermore, al-mustafīḍ ’s similarity or dissimilarity to the Ḥanafīs’ al-mashhūr and its categorical relations with the mutawātir and āḥād reports will also be examined. We may argue that discussions of Shāfiʿī’s on mustafīḍ reports have eventually approximated their position to the Ḥanafīs’ tripartite division of reports and minimized the differences between the two schools.
