摘要：O objetivo deste trabalho é o de tecer considerações legislativas relacionadas ao teletrabalho e à atividade do professor no ensino à distancia. Com o passar do tempo, diversas formas de trabalho têm sido modificadas. Na seara da educação não é diferente. Trata-se de uma pesquisa qualitativa, com uma abordagem apoiada no arcabouço teórico, bem como na doutrina jurídica que cobre o tema. Como resultado, na modalidade do Ensino a Distancia, os professores são os atores que fazem o processo se desenrolar por meio das tecnologias que estruturam a prestação do serviço. O período que nos circunda proporciona um cenário onde as relações desta modalidade de serviço capitaneada pela pandemia que se espalhou mundo a fora. A forma laboral do teletrabalho tem sido a principal ferramenta encontrada para que se dê continuidade às prestações de serviço como condição de manutenção de determinados ofícios. Dentro deste contexto, tem-se a função do professor, não apenas do ensino superior, mas de todas as formas de ensino. Deste modo, esta seara deverá ser regida pelas regulamentações já estabelecidas na Convenção Coletiva do Trabalho, (CCT), uma vez que rege as relações de trabalho nesta modalidade.
其他摘要：The aim of this work is to make legislative considerations related to teleworking and the teacher's activity in distance learning. Over time, different forms of work have been modified. Education is no different. It is a qualitative research, with an approach based on the theoretical framework, as well as on the legal doctrine that covers the topic. As a result, in the Distance Learning modality, teachers are the actors who make the process unfold through the technologies that structure the provision of the service. The period that surrounds us provides a scenario where the relations of this type of service led by the pandemic that has spread worldwide. The working form of teleworking has been the main tool found for the continuity of service provision as a condition for maintaining certain jobs. Within this context, there is the role of the teacher, not only in higher education, but in all forms of teaching. Thus, this area must be governed by the regulations already established in the Collective Labor Convention (CCT), since it governs labor relations in this modality.
