摘要：In this paper are shown not to indict solutions adopted by the prosecutor as set out in the New Code of Criminal Procedure,which amended substantially old regulation. We intend to analyze the dismissal and thhe withdrawal of the criminal proceedings as decisions adopted by the prosecutor according to art. 315-316 and 318 of the New Code of Criminal Procedure. According to the New Criminal Procedure Code,the termination of the criminal prosecution represents the moment when all the investigating actions are fulfilled and the file is to be forwarded to the Prosecutor. By using the expression “termination of the criminal prosecution” we understand that it is the decision of the bodies in charge with it regarding the fulfillment of all procedures necessary for the case solution,in order to forward the file to the Prosecutor.
