摘要：This article describes the features of the functioning of public and private enterprises. It was determined that private enterprises are based on the sole or collective ownership,with the exception of enterprises with state ownership and state-owned enterprises and related based on state ownership and collective ownership of the state share,respectively. It is shown that state-owned enterprises are unitary,and come in two forms:commercial and state-owned. The differences in the organizational,legal and managerial aspects of the functioning of state enterprises were established in contrast to private and public offices. The interesting form of functioning of a state ownership are the state enterprises,therefore,the legal bases of their activity were defined. The basic international approaches to the functioning of state-owned enterprises were analyzed in the article. European countries with developed economies,including Germany,Great Britain and France were selected as a comparative base. The obstacles to the activities of state enterprises were identified,and the need for legal regulation of state-owned enterprises to reduce their losses was noted.
