摘要：A judgment renderd by the High Commercial Court of Croatia,dated April 17,1984 ,deals with the relation between provisions of charterparty and of bill of lading. In this case,the shipowner issued bills of lading whose terms were contradictory to the terms of the charterparty,to the benefit of the charterer. Because the charterer accepted the bill of lading without objection,it is considered that the bill of lading modifies the charterparty in those parts in which its terms differ from the terms of the charterparty. Consequently,if the charterparty states the laydays and the demurrage,but the shipowner issued a Liner bill of lading,he is not entitled to demurrage because the Liner Terms exclude the application of provisions concerning laydays and demurrage (Art. 492 (1) of the Yugoslav Maritime & Inland Navigation Act 1978).
