摘要：The Constitutional Court's judgment of 11 July 2012,ruled on the unconstitutionality of the Act of 8 July 2005 of family allotment gardens. Because of that,it was necessary to develop a new law. Although the Court didn’t question existence need of allotment gardening in Poland,it was feared that the new law will include the regulations endeavoring to liquidation of allotment gardens. This fear had negative impact on condition and esthetics of allotment gardens. The research proved that,financial outlays,allocated for the using of plots,were reduced to minimum. Also repair works and new investments were withheld. The uncertain legal situation had also negative impact on allotment greenery. The vision of high compensations caused "artificial holding" and acquiring plots by persons who weren't interested in using of these plots. The work aims to present the consequences of the uncertain legal situation of family allotment gardens after the Constitutional Court's judgment.
