摘要：La imputación objetiva de la víctima en los delitos imprudentes por accidentes de tránsito en Ecuador; es una temática que, si bien es cierto se la puede aplicar desde la vigencia del Código Orgánico de la Función Judicial, los operadores de justicia jueces de primer nivel, Fiscales y Defensores Públicos no han utilizado esta herramienta legal para resolver los casos de delitos imprudentes (accidentes de tránsito) cuando la víctima se autopone en peligro. Sin embargo, la Corte Nacional de Justicia del Ecuador ha dictado algunos fallos de casación aplicando una de las categorías dogmáticas que recoge la Doctrina Penal, esta es, la Imputación Objetiva de la víctima.
其他摘要：The objective imputation of the victim in the imprudent crimes for traffic accidents in Ecuador is a thematic, that although it is true it can be applied from the validity of the Organic Code of the Judicial Function, the justice operators first level judges, Prosecutors and Public Defenders have not used this legal tool to resolve cases of reckless crimes (traffic accidents) when the victim puts herself in danger; however, the National Court of Justice of Ecuador has issued some cassation rulings applying one of the dogmatic categories included in the Criminal Doctrine, that is, the Objective Imputation of the victim.
