摘要：En el presente artículo, el autor nos presenta un análisis sobre el alcance del derecho de huelga en relación a los efectos que su ejercicio acarrea en los servicios públicos esenciales. En esa misma línea, se plantean dos perspectivas desde las cuales comprender este derecho colectivo: por un lado, la visión jurídica laboral y, por el otro, la visión jusadministrativa. Por último, el autor realiza una importante precisión sobre la calificación de los servicios públicos esenciales, no limitándose a actividades que puedan afectar solo la salud, vida y seguridad de los individuos, sino también otros derechos fundamentales o bienes jurídicos. In this article, the author presents an analysis on the scope of the right to strike in relation to the effects that these generate in the essential public services. In the same context, two perspectives are proposed from which this collective right is to be understood: on one hand, the legal Labour perspective, and on the other the Jusadministrative perspective. Finally, the author makes an important clarification on the rating of the essential public services as to not being limited just to activities that may only affect individuals’ health, life and safety, but also other fundamental rights or legal property.
