摘要：Este artigo tem como principal objetivo realizar uma análise do instituto da tentativa (conatus), notadamente verificando os critérios da passagem da fase de preparação para a execução do crime, segundo as teorias existentes no âmbito jurídico. O trabalho foi realizado por meio de pesquisas bibliográficas, principalmente em livros na área de Direito Penal. Trata-se de uma pesquisa descritiva, cujo método empregado é o dedutivo. É dedutivo porque é um processo de análise da informação que utiliza livros para obter uma conclusão a respeito do problema.
其他摘要：This article has as main objective to carry out a analysis of the attempted institute (conatus), notably verifying the criteria of the passage from the preparation phase to the execution of the crime, according to the existing theories in the legal scope. The work was carried out through bibliographic research, mainly in books in the area of Penal Law. It is a descriptive research, the deductive method used. It is deductive because it is an information analysis process that uses books to reach a conclusion about the problem.
