摘要：Una de las realidades más complejas que enfrentan las personas adultas mayores es cuando se encuentran privadas de libertad en un centro penitenciario, por ello, el presente artículo tiene como objetivo reflexionar acerca de sus derechos y de la importancia de hacerlos valer ante los órganos jurisdiccionales, aún y cuando han sido sentenciados por la comisión de un delito; es decir, se explicarán aspectos relativos del derecho de acceso a la justicia que tienen estas personas y el contexto en que se encuentran, pues no debe perderse de vista que la privación de libertad debe servir para los efectos de reinserción social, proteger a la sociedad contra el delito y reducir la reincidencia, pero no ser motivo para la violación de otros derechos. Por tanto, el presente artículo de enfoque cualitativo, pretende llevar a cabo un análisis documental, con la finalidad de tener una mirada de la realidad sociojurídica a la que se enfrentan.
其他摘要：One of the most complex realities faced by older adults is when they are deprived of their liberty in a penitentiary, therefore, this article aims to reflect on their rights and the importance of asserting them before jurisdictional bodies, even when they have been sentenced for the commission of a crime; In other words, they will explain the right of access to justice that these people have and the context in which they find themselves, since we should not lose sight of the fact that the deprivation of liberty must serve for the purposes of social reintegration, to protect society against crime and reduce recidivism, but not be a reason for the violation of other rights. Therefore, this article with a qualitative approach, aims to carry out a documentary analysis, in order to have a look at the socio-legal reality they face.
