摘要：O presente estudo trata de uma aproximação entre os campos comunicativos expressados por meio do Direito e da Literatura, em especial uma investigação no tema do Direito crítico Insurgente que aparece na série de obras literárias intituladas “Guerra silenciosa” do autor peruano Manuel Scorza. Essa categoria jurídica deve ser localizada na órbita dos Direitos Humanos como condição material de interpelação por justiça. Dessa forma, a teoria jurídica crítica do Direito Insurgente será o marco teórico pelo qual se irá abordar o tema dos Direitos Humanos nas referidas obras literárias, movida pela hipótese de que o campo literário quando aproximado ao campo jurídico evidencia elementos que possibilitam uma visão crítica ao fenômeno jurídico em sua modalidade formal. Por isso, o objetivo geral é aproximar Direito e Literatura no marco do Direito Insurgente e, em específico verificar como as obras de Manuel Scorza podem resgatar uma concepção jurídica própria latino-americana que visualiza o horizonte da luta por Direitos Humanos e libertação. A metodologia da investigação foi a pesquisa bibliográfica. Ao final serão apresentadas algumas perspectivas críticas do Direito no contexto latino-americano, em que através da guerra silenciosa será estabelecido um quadro das categorias aptas para compreender os Direitos Humanos como arma de libertação.
其他摘要：The present study deals with an approximation between the communicative fields expressed through Law and Literature, especially an investigation on the theme of Critical Insurgent Law that appears in the series of literary works entitled "Silent War" by the Peruvian author Manuel Scorza. This legal category must be located in the orbit of human rights as a material condition of interpellation for justice. In this way, the critical legal theory of Insurgent Law will be the theoretical framework by which the subject of human rights will be addressed in the mentioned works, driven by the hypothesis that the literary field when approaching the juridical field evidences elements that allow a critical view of the phenomenon In its formal modality. Therefore, the objectives are generally to approximate law and literature within the framework of insurgent law, and specifically to verify how the works of Manuel Scorza can rescue a Latin American own legal concept that visualizes the horizon of the struggle for Human Rights and liberation. The research methodology was the bibliographical research. In the end, some critical perspectives of Law will be presented in the Latin American context, where through the silent war the framework of the categories capable of understanding Human Rights as a weapon of liberation will be established.
