摘要：A Constituição Federal de 1988 assegura o direito social à moradia e dedica um capítulo à política urbana, com vistas à construção de espaços urbanos inclusivos. No entanto, em face do aumento de assentamentos informais, parte da população brasileira não consegue usufruir de seu direito à moradia digna, o que torna a política de regularização fundiária uma forma de combater este quadro. Com o advento de uma nova lei federal de regularização fundiária urbana, Lei n.º 13.465/2017, este artigo tem por objetivo analisar o instituto jurídico da legitimação fundiária, criado por esta lei. Trata-se de pesquisa bibliográfica e documental, com abordagem qualitativa. Contatou-se que a Lei n.º 13.465/2017 trouxe avanços e retrocessos, tendo por fio condutor a proteção do direito à moradia, mas que é possível utilizar a legitimação fundiária sob a ótica da Carta de 88 e do Estatuto da Cidade, com a meta de construir espaços urbanos mais inclusivos e democratizar o acesso ao solo urbano.
其他摘要：The Federal Constitution of 1988 ensures the social right to housing and devotes a chapter to urban policy, to build inclusive urban spaces. However, due to the increase of informal settlements, part of the Brazilian population cannot enjoy their right to decent housing, which makes the policy of land regularization a way to combat this situation. With the advent of a new federal urban land regularization law, Law n.º 13.465/2017, this article aims to analyze the legal institute of land legitimation created by this law. It is a bibliographic and documentary research, with a qualitative approach. It was noted that Law n.º 13.465/2017 brought advances and setbacks in order to protect the right to housing, but it is possible to use land legitimation from the perspective of the Charter of 88 and the City Statute, with the goal of building more inclusive urban spaces and democratizing access to urban land.
