摘要:Nevertheless current labour market rates in Brazil mark a substantial employment recovery and an important decrease in informal labour work, precarious employment is expanding, as it the case of outsourcing. This stirs up inequalities and fragments workers organization. Unlike other Latin American countries, in Brazil there is no specific law regulating outsourcing. In this legal vacuum, Superior Labor Court (TST) cancelled in 1993 Precedent 256, which in practice, refrained the outsourcing, and edited Precedent 331. This paper will analyze TST decisions of period 2000 - 2013, based on research carried out under axis of outsourcing environment of the thematic project “Current Brazilian Labour contradictions: formalization, precariousness, outsourcing and regulation”.
