摘要：El Derecho Civil aparece con un aporte en desusó, y hasta olvidado por la comunidad jurídica del Ecuador con el que pretende proteger los derechos difusos de individuos indeterminados atados a un hecho que se considerado daño contingente; el Art. 2236 del Código Civil, lo prescribe como Acción Popular. Esta investigación determina la frecuencia del uso de la acción popular como mecanismo reparador de daño contingente de los derechos difusos. La modalidad de investigación fue mixta, con mayor cuantitativa, no experimental con alcance descriptiva; se utilizaron métodos deductivo–inductivo y análisis documental, mediante entrevistas a jueces; abogados litigantes; revisión de normativas nacional, extranjera, y bibliografía, obteniendo como resultado un total desconocimiento de la Acción Popular en el Derecho Civil.
其他摘要：The Civil Law appears with a contribution in disuse, and even forgotten by the legal community of Ecuador with which it intends to protect the diffuse rights of indeterminate individuals tied to an event that is considered contingent damage; Art. 2236 of the Civil Code prescribes it as Popular Action. This research determines the frequency of the use of the popular action as a mechanism to repair contingent damage of diffuse rights. The research modality was mixed, with a greater quantitative, non-experimental and descriptive scope; deductive-inductive methods and documentary analysis were used, through interviews to judges; litigant lawyers; review of national and foreign regulations, and bibliography, obtaining as a result a total lack of knowledge of the Popular Action in Civil Law.
