摘要：La investigación tiene como objetivo: analizar la supremacía de la moralidad sobre la legalidad procesal desde los poderes de instrucción del juez en relación con la moralidad y legalidad estableciendo mecanismos alternativos de solución de conflictos antes de acudir a la justicia ordinaria. Fue necesario desarrollar una investigación transversal cuali-cuantitativa con la utilización de herramientas de investigación como son la encuesta, obteniendo como resultado que la legalidad y la moralidad son conceptos diferentes dentro del marco normativo. En los antecedentes bibliográficos, se puede reafirmar, la relevancia de agotar medios alternativos de solución de conflictos que permiten mayor flexibilidad de toma de decisiones apegadas a los aspectos morales antes que a la legalidad.
其他摘要：The objective of the research is to analyze the supremacy of morality over procedural legality from the investigative powers of the judge in relation to morality and legality, establishing alternative dispute resolution mechanisms before resorting to ordinary justice. It was necessary to develop a quali-quantitative cross-sectional investigation with the use of research tools such as the survey, obtaining as a result that legality and morality are different concepts within the regulatory framework. In the bibliographic background, it is possible to reaffirm the relevance of exhausting alternative means of conflict resolution that allow greater flexibility in decision-making attached to moral aspects rather than legality.
