摘要：Mediante el presente trabajo se pretende proyectar un análisis del delito de prevaricato concentrándose en las actuaciones que comprenden las decisiones de los jueces ya que el contenido de los artículos 268 y 269 del Código Orgánico Integral Penal, se refieren también al prevaricato de los árbitros y abogados. El objeto de estudio es principalmente el derecho penal; sin embargo, se abordarán antecedentes históricos y doctrinarios para entender el alcance de su tipificación, tomando en consideración criterios subjetivos y objetivos, la realidad histórica y factores políticos y sociales que influyen en las decisiones tomadas por los servidores judiciales (jueces) en la emisión de los autos y sentencias orales y escritos.
其他摘要：Through this work, we intend to project an analysis of the crime of prevarication, concentrating on the actions that include the decisions of judges, since the content of articles 268 and 269 of the Organic Integral Penal Code also refer to the prevarication of arbitrators and lawyers. The object of study is mainly criminal law, however, historical and doctrinal background will be addressed to understand the scope of its typification, taking into consideration subjective and objective criteria, historical reality and political and social factors that influence the decisions made by judicial servants (judges) in the issuance of oral and written orders and judgments.
