摘要：El Ecuador es un Estado constitucional de derechos y justicia, tal como lo establece la Constitución de la República en el Art. 1, dentro de los derechos fundamentales nos garantiza el derecho a la salud que ha sido vulnerado desde varias perspectivas en medio de la pandemia de COVID-2019. El objetivo central de la ponencia es analizar el papel del Estado al garantizar este derecho al personal de salud, cuáles fueron sus fortalezas y falencias. La metodología de investigación es cualitativa - cuantitativa, bajo la investigación jurídica de carácter documental con la interpretación hermenéutica de la bibliografía consultada. Se determinó las falencias del sistema de salud, al no ser un sistema integral y las actuaciones corruptas de sus representantes.
其他摘要：Ecuador is a constitutional State of rights and justice, as established in the Constitution of the Republic in Art. 1, within the fundamental rights it guarantees us the right to health that has been violated from various perspectives in the midst of the pandemic of COVID-2019. The central objective of the presentation is to analyze the role of the State in guaranteeing this right to health personnel, what were its strengths and weaknesses. The research methodology is qualitative - quantitative, under documentary legal research with the hermeneutical interpretation of the consulted bibliography. The shortcomings of the health system were determined, as it is not a comprehensive system and the corrupt actions of its representatives.
