摘要:Pasca pengaturan Undang-Undang Administrasi Pemerintahan, berimplikasi terhadap pergeseran rezim Keputusan Tata Usaha Negara yang mulanya fiktif negatif menjadi rezim fiktif positif. Namun adanya pengaturan dalam Undang-Undang Administrasi Pemerintahan mengandung sejumlah kendala yang dihadapi dalam ranah praktikal oleh Hakim Peradilan Tata Usaha Negara. Kendatipun muncul regulasi Mahkamah Agung namun Hakim Peradilan Tata Usaha Negara mencari cara yang paling tepat dalam penerapan rezim fiktif positif pada sistem Hukum Acara Peradilan Tata Usaha Negara. Tujuan penelitian ini adalah mengkaji dan mengetahui kendala-kendala serta cara Hakim Peradilan Tata Usaha Negara dalam mengatasi kendala-kendala praktikal pasca kemunculan rezim fiktif positif melalui Undang-Undang Administrasi Pemerintahan. Hasil studi ini disajikan dalam suatu tulisan deskriptif analisis.
其他摘要:After the enactment of the Law of Government Administration, had implied to shifting paradigm concerning the regime of Administrative Decision from negative fictive became positive fictive. However, the regulation into Law of Government Administration contains several obstacles on pratical scope towards Administrative Court Judges. Meanwhile enactment of Supreme Court regulation however Adiministrative Court Judges searching the suitable method after implication of positive fictive regime in the Administrative Procedural Law System. This study aims to analyze and discuss concerning obstacles and method by the Administrative Court Judges solving the practical obstacles after enactment of the Law of Government Administration. This study results is presented in a descriptive analysis paper.
