Continuing legal education seminar to focus on practice in NY State
Daily Record StaffThe New York State Court of Claims is the exclusive forum for civil litigation seeking damages against the State of New York or certain other state-related entities such as the New York State Thruway Authority and the New York State Power Authority (claims for the appropriation of real property only).
Retired presiding judge and current judicial hearing officer of the Court of Claims, Judge Donald J. Corbett Jr., and Assistant Attorney General James L. Gelormini, will hold a continuing legal education seminar from noon to 2 p.m. on Thursday, Oct. 6 at the Crowne Plaza Hotel. They have arranged for Court of Claims Judges Renee Forgensi Minarik and Philip J. Patti; Sean Gleason (counsel to Judge Minarik); Michael B. Kirschen (counsel to Judge Patti); and Court of Claims Court Monitor Lisa Olson to speak on the following topics:
Procedure
* Entities subject to suit in Court of Claims;
* Processing of claims, fixing venue;
* Fax filing;
* Motion practice, dates by judge, pre-trial disclosure disputes;
* Section 10, which provides time guidelines for filing claims; and
* Differences between Court of Claims and general municipal law;
Trial Practice
* Preliminary conference and scheduling orders;
* TPC conference, exhibit/witness lists, etc.;
* Bifurcation, body orders for inmates with stipulations; and
* Settlements.
Substantive Law
* Weiss v. Fote;
* State constitutional tort; and
* Discretionary function/immunity/special relationship.
