House approves bankruptcy reform

Credit union members' right to voluntarily reaffirm their debts would be protected under legislation passed last Thursday by the House of Representatives.

H.R. 2415, now known as the Gekas-Grassley Act, contains the House-Senate bankruptcy conference report - including a means test to ensure that consumers who can afford to repay their debts could not abuse the bankruptcy system, and mandatory financial education to help potentially troubled debtors.

But now the bill faces a possible Senate filibuster and a White House veto threat. Capitol Hill sources indicate the Senate debate can be curtailed and a final vote taken this Friday.

"We hope the Senate and the White House will move expeditiously to consider this fair, balanced, bipartisan legislation," said CUNA President & CEO Dan Mica. "Achieving meaningful bankruptcy reform has been our top priority this year. We applaud this encouraging step in the long struggle to reform the seriously flawed bankruptcy code."
