Court dismisses class-action lawsuit against Nash Finch

MINNEAPOLIS-The U.S. District Court for the District of Minnesota dismissed a class-action lawsuit June 28, filed in 2002 against supermarket operator and distributor Nash Finch Co., also based here.
The consolidated class action alleged Nash Finch and certain executive officers violated the Securities Exchange Act of 1934 by purportedly issuing false statements about the company's business and financial results in connection with vendor promotions. Consolidated actions filed in Minnesota state court against Nash Finch's board of directors and certain officers were also dismissed with prejudice.
The dismissals are subject to appeal. Nash Finch owns and operates supermarkets primarily in the Upper Midwest, and its food distribution business serves independent retailers and military commissaries in 27 states.
