摘要：This article tries to justify the importance of the Antitrust policy and to explain how its analytical fundamentals have been improved, from the initial paradigm structure-conduct-results to the new industrial economy. Three areas will be analysed —the horizontal mergers, the occlusive practices and the vertical restraint— relating the analytical developments with the change in the criteria followed by the Antitrust policy. Finally it will be given a synthesis about the aspects relative to the institutional design of the antitrust organisms, the fact that allows to make some commentaries about the decree which regulates the creation of the Basque Antitrust Court.
