摘要:The constitutionalising of environmental rights can contribute to environmental justice
globally. This is argued in response to concerns that constitutionalising environmental
rights in affluent societies would leave untouched, or even worsened, the position of poorer
countries. The first section shows why the focus on environmental rights at the level of
states can be regarded as necessary for the development of global environmental justice.
The second explains why the interests of poorer countries need not oppose promoting
constitutional environmental rights in richer countries; they lie, rather, in securing those rights
for themselves. Section 3 indicates how constitutional environmental rights play a constructive
role in less advantaged countries, where some of the most important precedents
in this field originate
