摘要:Since the promulgation of the Federal Constitution of 1988, a new actor started to participate in the process of grant of broadcasting concessions: the Legislative. In accordance with the main legal landmark of the country, the National Congress would be responsible for fiscalizing the concessions granted by the Executive. This article’s objective is to argue the transparency of this model and the possibility of correction of its imperfections, according to the principles of reforms in the State’s context, that conducts the contemporary political scene. The historical research done for this article involves legal documents, official reports and other publications. It’s evident the inefficiency of the fiscalization of the Brazilian broadcasting made by the Legislative, mainly because parliamentarians are themselves directly interested in the oncessions. It’s suggested a more intense participation of the civil society in this process, based on the consolidation of official institutions and processes. It is improbable, however, that there will be political interest for the approval of a structure with thischaracteristic.
