In order to design the guidelines of a proposal for penitentiary and post-penitentiary labor assistance as a fundamental premise for the social re-integration of the prisoner, previous investigations were considered that emphasize the importance of formulating labour programs for prisoners and the legal and social antecedents regarding the research problem. In this respect, following a methodological approach of the documentary, qualitative and projective type, the lack of mechanisms for inclusion of the prisoner population was determined, even when the constitution takes a step forward in terms of the prison system and social participation. This study recommends establishing a long-term penitentiary policy and making society aware regarding the transcendence of its protagonistic participation in executing penitentiary policies and the need to integrate and incorporate the prisoner in social life. This leads to the need to carry out a great national consultation to draft and promulgate a Law on Penitentiary and Post-penitentiary Work, with the purpose of social re-insertion of the penitentiary system.
