Durante fines del siglo XIX y las primeras décadas del siglo XX, el mundo se vio influenciado por las ideas eugenésicas. Con varios argumentos se sostenía que el hombre debía interceder a favor del desarrollo de los buenos representantes de la raza y limitar el crecimiento de aquellos que se consideraban indeseables y contribuían a su debilitamiento. Dentro de las medidas tomadas, se llevó a cabo la creación de marcos legales que permitieron un control minucioso de la población a fin de detectar personas con estigmas indeseables. La Argentina no fue ajena a ese proceso. En este artículo se repasa la historia del Código Penal Argentino en el periodo 1853-1922, se analizan las controversias respecto a la interpretación de la redacción de los incisos del Artículo 86 y se examinan las concepciones ideológicas de aquellos que generaron los artículos de la ley penal que expresan las condiciones en que debe considerarse punible y no punible el aborto en la Argentina.

By the end of the 19th and the first decades of the 20th century, the world was influenced by eugenic ideas. Different arguments sustained that man should intercede in favor of the development of the good specimen of the race and restrict the growth of those who were considered undesirable for weakening the breed. Between all the actions that were taken we may find the creation of legal frameworks that allowed a thorough control of population for the detection of people with unwanted stigma. Argentina did not escape this trend. This article will go over the history of the Argentinean Penal Code in the period 1853-1922, analyze the controversies concerning the interpretation of the Article 86, and will examine the ideological conceptions of those who shaped the article that expresses the conditions to consider abortion in Argentina punishable or unpunishable.
