摘要:The current status of demented persons in forensic situations raises important ethical considerations concerning equality and rights to equal treatment in court. This issue, therefore, deserves special attention of lawyers and all relevant institutions. Neuropsychology is expected to offer an empirical basis for creation of legal strategies in the work with this specific population, which have been lacking so far. The paper presents an analyjsis of the current forensic situation with respect to dementias and suggests possible ways of overcoming unjust circumstances. Consequently, only a competent expert witness can adequately recognize the level of competency of a demented person in the forensic settings.
