Ronald Dworkin, modern hukuk kavramsallaştırması içerisinde sivil itaatsizliği yeniden tanımlamıştır. Bu tanımın temel hareket noktası, modern hukuk kavrayışındaki hakim pozitivist bakış açısının eleştirisine dayanır. Bu eleştiri, hem sivil itaatsizliğin tanımına hem de onun adli anlamda yargılanmasına yeni bir bakış açısı getirmiştir. Bu çalışma, Ronald Dworkin’in sivil itaatsizliğe yönelik yeni bakış açısını incelerken, aynı zamanda sivil itaatsizliği, modern hukukun pozitivist yapısının liberal bir eleştirisi olarak okumanın imkanını arayacaktır.

Civil disobedience has been redefinated by Ronald Dworkin. The starting point of this redefinition about civil disobedience based on the critique of the dominant positivistic view in conception of the modern law. This critique has brought about a new opinion of both political description and juridical judgement of civil disobedience. While this study tries to investigate Ronald Dworkin’s new opinion about civil disobedience, at the same time it investigates possibility of a liberal critical reading of positivistic structure of modern law conception.
