摘要：The current Civil Code regulates in the 5thBook, "About Obligations", the 2ndTitle, "Sources of Obligations", Chapter IV "Civil Responsibility", the 5thSection "Responsibility for the Prejudice Caused by Animals or by Objects", art.1375-1380. The commitment of the responsibility for the prejudices caused by animals or by objects raises the problem of guarding them. The guard of the object or of the animal is actually a juridical and material guard. Under the aspect of the juridical responsibility, we should consider the juridical guard, namely the power to legally and independently execute the control and the surveillance on an animal or on an object directly or indirectly used in the own interest, not the material guard consisting of the simple surveillance of the animal or of the object accomplished with the authority and in the interest of the juridical guardian.
