摘要：Marriage contract is the legal agreement that relationship is built upon it between the partners. There are some conditions to estab-lish this contracting according the Islamic law. Some of these conditions are concord but others are contraversial. Whether it is the contraversial condition that the permission of woman’s guar- dian is neccessary or not. The basic reference whose opinion is the permission of guardian is neccessary is tahat hadith: “The marriage of woman depends on her guardian’s permission.” In this article it is dealed that the sanad and matn features of this hadith, and criticising the hadith by sects of fıqh
