摘要：This article provides an overview of the procedures in place for the allocation and registration of Internet domain names and shows how these procedures have come into conflict with laws protecting registered trade marks. The article addresses the question of whether the current Australian law is able to deal with the problem of domain names infringing registered trade marks, with a focus on US and UK case law as a guide. It is argued that while the Australian law is most likely adequate to deal with this problem, greater international effort is needed to reform the Domain Name System so that the interests of trade mark holders may be better protected than they are at present
