摘要:Difficult questions regarding the so-called li mits of toleration or accommodation are i nevitable in today's diverse, immigration societies. Such questions cannot be satisfactori ly answered through simple asser tions of the majority's wil l or by retreating to a defense of 'core l iberal values.' Rather, dealing with the challenges of diversit y in a manner consistent with l iberal-democratic pr inciples requires that decision-mak ing concerning the ter ms of col lective l ife be infor med by sincere and respectful deliberation. But how and where do we go about engaging in such deliberation. This essay suggests that the courts seem to offer an arena that i s more conducive than other traditional democratic institutions i n ter ms of enabl ing the type of dialogue and analysi s essential to realizing meaningful deliberation. Paradox ically, then, the judicial ization of politics can be under stood to be an ally, not an enemy, of meaningful deliberation in diverse democracies
