摘要：The recent case of Sony v. Hi-Fi Express Inc. provides an excellent backdrop for a discussion of the relationship between a tort analysis and an antitrust analysis of passing off cases. Both perspectives are explored, with pertinent examples. A set of guidelines for deciding similar cases is suggested and applied to the decision in Sony.
