标题：«¿Cómo quitarles esas tierras en un día después de 200 años de posesión?» Enfiteusis, legislación y práctica en la Quebrada de Humahuaca (Argentina)

摘要：La aplicación de la enfiteusis en la provincia de Jujuy en el proceso de desamortización iniciado en 1839, fue parte de una política de tierras proyectada sobre las de la antigua comunidad indígena, en la Quebrada de Humahuaca, que se caracterizó por el dominio compartido entre el Estado y los pobladores. En la segunda mitad del siglo XIX hasta la década de 1920, en pos de la imposición de la propiedad privada, se buscó cambiar este estatus «perfeccionando la propiedad». El artículo analiza las implicancias, resultados y variaciones a través del tiempo de este largo proceso, indagando en la legislación, los discursos en torno a la propiedad, las modalidades de la implementación de la enfiteusis y otras formas de acceso a la tierra fiscal, los intereses de los actores involucrados y la estructura agraria resultante.
其他摘要：In «Quebrada de Humahuaca», during the seizure of estates beginning in 1839, emphyteusis was the property policy applied to the native community. This method was characterized by the state and community control of lands. Beginning in the second half of XIX century until the 1920s, this system was changed in order to «improve property» by imposing private ownership. This article studies the implications, results and variations over time in this long process: the relevant legislation behind these changes is analyzed with a focus on concerns with the concept of property, the modalities in the implementation of the emphyteusis method, alternative ways of access to fiscal lands, the interests of the actors involved, and the resulting agrarian structure.
