摘要：Se estudia el concepto de la «jurisdicción normativa» y sus consecuencias jurídicas, a partir de la sentencia 301/2007, de 27 de febrero, de la Sala Constitucional del Tribunal Supremo de Justicia. En particular, se examinará el control de oficio de la constitucionalidad como potestad de la Sala como máximo y último intérprete de la Constitución y garante del orden público constitucional, su doctrina sobre las sentencias interpretativas, y si la jurisdicción normativa supone una usurpación de funciones y afecta la seguridad jurídica. Para este estudio se realizó una investigación documental, con base en el análisis de la doctrina nacional y extranjera y la jurisprudencia de la Sala Constitucional. Se concluye con algunas reflexiones sobre la legitimidad del ejercicio de la jurisdicción normativa por la Sala Constitucional, recomendando la necesidad de idear ciertos cambios en la legislación que regula la actividad de la Sala Constitucional para evitar posibles conflictos entre los poderes públicos.
其他摘要：In this paper we study the concept of «normative jurisdiction» and its juridical consequences, with base in the judgment 301/2007, February 27th, from the Constitutional Branch of the Supreme Court of Justice. Especia- lly, here we examine the ex officio control of the constitutionality as legal power of the Constitutional Branch, who is the maximum and last interpreter of the Constitution and guarantor of the public constitutional order, its doctrine on interpretive judgments, and if the normative jurisdiction supposes a usurpation of power and affects the legal certainty. In order to study this situation a documentary research was realized, by means of the analysis of the national and foreign doctrine and the jurisprudence of the Constitucional Branch. The review concludes with some reflections on the legitimacy of the exercise of the normative jurisdiction for the Constitutional Branch, recommending the need to design some changes in the legislation that regulates the activity of the Constitutional Branch to avoid possible conflicts among the branches of the State.
