摘要：E l artículo se concentra en el análisis del ejercicio del trabajo por cuenta propia desde la óptica del Derecho Mercantil en Cuba, revisando su régimen jurídico y su concreción en el sistema de derecho en relación con el nuevo modelo económico cubano en el siglo XXI. Adicionalmente, explora su relación con la sindicalización, la política de seguridad social, la política de crédito y tributaria. Como objetivo se propone determinar la situación actual del trabajo no estatal, partiendo de su definición legal y de su inserción en la realidad económica cubana, así como también revisa su evolución desde comienzo del triunfo revolucionario hasta la actualidad en su tracto histórico-jurídico. Se emplearon como métodos el exegético jurídico y el histórico lógico. Desde estas perspectivas, se realizó el análisis de los principios que se establecen en la legislación para los trabajadores por cuenta propia, apreciándose una ruptura conceptual en cuanto a la actividad que pueden desarrollar éstos y la que realizan los empresarios individuales.
其他摘要：This article analyses the exercise of self-employment from the optics of the Commercial Law in Cuba, checking the juridical regime and its effective application of new cost- reducing model of the century XXI in Cuba. Additionally, it explores the unionization, the policy of social security, the tax policy and credit policy. The goal is to determine the present situation of the self-employment work, beginning by its legal definition and its insertion in the Cuban economic reality, and also is to explore the evolution of the concept from the beginning of the revolution to the present time in his historic juridical tract. Exegetic juridical and historic logician methods were used. From these perspectives, it was conducted an analysis of the principles that become established in the legislation for the independent labor force, and a conceptual breakthrough was discovered in terms of the activities that can be held by individuals workers and entrepreneurs.
