摘要：En el presente trabajo se examina el contexto institucional en el que se aprueba la nueva Ley del Trabajo, destacándose el momento de su aprobación, la intervención de los actores en ese proceso, especialmente el papel del Estado, la necesidad del diálogo social y las opciones. Asimismo, se analiza la inconstitucionalidad de la legislación delegada como mecanismo utilizado para su aprobación. También se revisa aquellos aspectos del texto legal, que se consideran de importancia para el análisis contextual. Finalmente, se hace algunas propuestas para un necesario debate
其他摘要：In the present work it is discussed the institutional context in which is approved the new labor law, highlighting the moment of its adoption, the intervention of the actors in this process, specially the role of the State, the need for social dialogue and the options. Also, it discusses the unconstitutionality of delegated legislation as the mechanism used for approval. It also reviews those aspects of the legal text, which are considered to be of importance for the contextual analysis. Finally, some proposals for a necessary debate are made
