摘要：O artigo busca analisar, a partir da ocorrência da “Intentona Comunista” em 1935, a articulação entre mudança constitucional e estado de exceção durante o governo do presidente brasileiro Getúlio Vargas no período compreendido entre 1935 e 1937. O exame recairá sobre o contexto histórico e os debates parlamentares relacionados à reforma da Constituição brasileira de 1934 que pretendeu equiparar os efeitos do Estado de Sítio ao Estado de Guerra. Analisa, ainda, as consequências políticas e jurídicas da mencionada equiparação, bem como tenta resgatar os antecedentes e as justificativas para o golpe de estado ocorrido em 1937 e que deu início ao período conhecido como Estado Novo.
其他摘要：This paper analyzes the relationship between constitutional change and state of exception during the administration of Brazilian President Getúlio Vargas in the period between 1935 and 1937. The analysis will be on the historical context and the parliamentary debates related to the reform of the Brazilian Constitution of 1934 that aimed to increase the effects of the state of emergency. It also analyzes the political and legal consequences of that equation as well as attempts to rescue the background and justifications for the coup occurred in 1937 that began the period known as “Estado Novo”.
