摘要：Las constituciones son expresión de una tradición jurídica y política, de doctrinas e ideas políticas prevalecientes acerca de lo necesario para el ejercicio en el poder y el desarrollo de la sociedad y, en especial, de esas nociones acerca de los valores superiores: de lo justo, de la equidad, la igualdad y la libertad. Si tenemos en cuenta que una Constitución, sus contenidos básicos, así como los caracteres de sus normas, son el resultado de la voluntad constituyente, no como noción filosófica, no como abstracción, sino como expresión de las fuerzas políticas prevalecientes en una sociedad en algún momento histórico determinado, en circunstancias concretas políticas, socioeconómicas y culturales, entonces la realización plena de sus postulados es una condicionante de la reproducción de la legitimidad del orden que tutela y asegura. Sus postulados generales, marco para la creación y la acción jurídico-política a la vez que reservorio de los derechos esenciales del hombre, en su consideración individual o colectiva, han de ser concretados por sus principales intérpretes, a saber: el órgano legislativo y el aparato judicial. Por lo que ella contiene -regula-, los principios, valores y postulados esenciales de una sociedad, ha de evitarse que éstos se vean disminuidos o inaplicados por falta de instrumentación jurídica y material por el legislador o los órganos estatales competentes.

If we keep in mind that a Constitution, their basic contents, as well as the characters of their norms, are the result of the constituent will, I don't eat philosophical notion, I don't eat abstraction, but I eat expression of the prevalent political forces in a society in certain historical moment, in political, socioeconomic and cultural concrete circumstances, then the full realization of their postulates is a condition of the reproduction of the genuineness of the order that guides and it assures. Their general postulates, mark for the creation and the action juridical-politics at the same time that it contains the man's essential rights, in their individual or collective consideration, they must be summed up by their main interpreters, that is: the legislative organ and the judicial apparatus. For what she contains, the principles, securities and postulates essentials of a society, it must avoid that these are diminished or they are affected in their application by lack of artificial instrumentation and material for the legislator or the competent state organs.
