摘要：El autor revisa un trabajo de comienzos de la década de los noventa, relativo a la constitucionalización del mercado. En primer lugar, mediante ejemplos, recuerda la actualidad del tema pese al tiempo trascurrido. A continuación reincide sobre las siete tesis que propuso en el estudio constitucional del mercado. El mercado no es una realidad natural dada, sino un sector social que ha de ser constituido. Tal presupuesto se pone de manifiesto en los textos clásicos y en los textos constitucionales. Posteriormente analiza las similitudes entre la democracia y la economía de mercado, a la vez que fija los límites de ésta. Concluye afirmando que la economía social de mercado ha de ser una tercera vía entre el socialismo y el capitalismo, que debe reflejarse en los textos constitucionales.
其他摘要：Presently article the author revises a work of beginnings of the decade of the ninety, relative to the regulation in the Constitution of the market. In the first place, by means of examples, it highlights the present time of the topic. Next it backslides on the seven theses that proposed in the constitutional study of the market. The market is not a given natural reality, but a social sector that must be constituted. Such a budget shows in the classic texts and in the constitutional texts. Later on it analyzes the similarities between the democracy and the market economy, at the same time that it fixes the limits of this. It concludes affirming that the social economy of market must be a third via among the socialism and the capitalism that he/she should be reflected in the constitutional texts.
