摘要：Partiendo de la hipótesis de que el momento constitucional ecuatoriano conjuga dos perspectivas jurídicas antagónicas: el positivismo jurídico y el enfoque iusnaturalista, el autor sostiene que para evitar la adopción de modelos extranjeros a la realidad jurídica y social de su país, tiene que discutirse primero el concepto de derecho y su significación cultural. Reflexiona sobre el papel protagónico que el positivismo jurídico tuvo a lo largo del siglo xx en Ecuador, con el objeto de discutirlo, repensarlo y concederle el lugar que merece.
其他摘要：Ecuadorian constitutional moment brings together two antagonistic legal perspectives; the legal positivism and the naturalistic focus ius gives it. The author withholds that in order to avoid the foreign models adoption to the legal and social reality of his country, the concept of law has to be discus first along with his cultural meaning. He reflects about his main character role that the legal positivism has had all along the xxth century, with the means of discussing it, rethink it and allowed it the place it deserves.
