摘要：O presente artigo apresenta reflexões sobre a História do Direito em dois sentidos complementares: o das contribuições da pesquisa histórica sobre o Direito para a pesquisa em Ciência Política e Crítica da doutrina jurídica, e o da abertura do jurista historiador aos materiais e pesquisas de Ciência Política, Sociologia e História Social, como momento necessário para a sua pesquisa na formação e transformações das instituições jurídicas brasileiras. O artigo ilustra as reflexões com análises de trabalhos sobre a jurisdição constitucional no Brasil contemporâneo e a produção do Direito no Segundo Reinado. Enfim, propõe pesquisas sistemáticas sobre o processo político, história do pensamento jurídico e mudança social para entender as especificidades das instituições e da tradição jurídica brasileira.
其他摘要：Investigations are provided on the history of Law within two complementary meanings: the contributions of historical research on Law within the context of political science and the critique of juridical doctrine and the open vision of the law historian towards the materials and research of Political Science, Sociology and Social History as an occasion for research on the formation and transformation of the Brazilian juridical institutions. The investigation comprises research analysis with regard to the juridical constitution in contemporary Brazil and Law production in the period of the Second Kingdom. It also proposes systematic research on the political process, the history of juridical thought and social change so that the institution's and Brazilian juridical tradition’s specificities could be understood
