摘要：La transición democrática en México supuso como requisito indispensable la existencia de un Poder Judicial independiente, sometido únicamente al imperio de la ley. El presente ensayo examina la problemática que se ha suscitado a raíz de la creación del Consejo de la Judicatura Federal en la escena constitucional. Según explica el autor, desde la reforma constitucional de diciembre de 1994, dicho consejo se ha convertido en el eje central para el adecuado funcionamiento del Poder Judicial federal, constituyéndose en el generador de la modernización y profesionalización de la administración de justicia federal, y estableciendo nuevas fórmulas para la selección, el nombramiento y la capacitación de los secretarios, jueces y magistrados. No obstante, el autor explica que su función como órgano garante de la independencia del Poder Judicial se ha visto empañada por su relación con la Suprema Corte de Justicia; relación que no termina por definirse.
其他摘要：The transition to democracy in Mexico has implied as a necessary require-ment the existence of a more independent judicial branch of government, solely subjected to the rule of law. This essay examines the problems derived as a consequence of the cre-ation of the Federal Council of the Judiciary in the constitutional scene. According to the author, since the constitutional reform of December 1994, this Council has become a central player for an adequate functioning of the federal judicial power, with its contribu-tion to the modernization and professionali-zation of the federal administration of justice, by establishing new rules for the selection, appointment and training of clerks, judges and magistrates. However, the author ex-plains that its function as an institution that guarantees the independence of the federal judicial power has been affected by its relation with the Supreme Court of Justice; a relation that has not been definitely settled.
